Terms of use
Last updated: 07.09.2026
This is a translation of the Polish Regulamin. The Polish version is the binding one, because stamplik operates in Poland and Polish law governs it.
These are the terms of service required by article 8 of the Polish Act of 18 July 2002 on providing services by electronic means.
1. Who provides the service
Radosław Kraj, trading as Radosław Kraj, ul. Pychowicka 3B/72, 30-364 Kraków, Poland, NIP 6762699438, REGON 542399330.
Contact: hi@stamplik.app.
2. Terms used here
- An Account is one signed-in person. One person has one Account, whether they collect Stamps or run a Business.
- A Customer is an Account collecting Stamps.
- A Business is the trader issuing Stamps. The Owner is the Account that created it, and Staff are the Accounts allowed to stamp on its behalf.
- A Venue is a physical location belonging to a Business.
- A Program is the rule a Business sets, for example ten Stamps for a free haircut. It holds Reward Tiers and Rewards.
- A Card records one Customer’s relationship with one Business: their stamp count and history.
- A Stamp is one unit of progress on a Card.
- A Redemption is claiming a Reward, confirmed by Staff.
3. What the service does
stamplik replaces a paper stamp card. A Business creates a Program, Staff stamp from their own phone, and a Customer scans a code with their camera and collects Stamps on a Card. Once a Threshold is passed, the Customer shows a code and Staff confirm the Redemption.
The service is provided over the internet, through a browser. Nothing needs to be installed, though the app can be added to a phone’s home screen.
Rewards are provided and handed over by the Business, not by us. We are not party to what a Business promises its Customers, we do not sell Rewards and we take no payment for them. Our service is counting Stamps.
During the Kraków pilot the service is free for Businesses, and it is always free for Customers. If charges for Businesses are introduced we will give notice beforehand, and a Business will be free to stop using the service.
4. Technical requirements
A phone, tablet or computer with a current browser supporting JavaScript and local storage, and an internet connection. Stamping and scanning need a camera.
The service does not work offline. With no signal at the counter, no Stamp is granted.
Using the internet carries the usual risks, in particular that third parties may intercept data or that a device may be infected with malicious software. We connect only over HTTPS, but we have no control over the security of your device.
5. Starting and ending the agreement
The agreement is concluded when you first sign in, at which point you accept these terms. For a Customer that usually happens the first time they scan a code.
The service is for people aged 16 and over.
You may end the agreement at any time, without giving a reason and at no cost, by writing to hi@stamplik.app. We then delete the Account and all data associated with it, as described in the Privacy policy.
If a Business Owner asks for deletion, we also delete the Business, its Programs, Venues and its Customers’ Cards.
We may block an Account that breaks these terms, in particular one attempting to generate Stamps without a real transaction. We will give notice by email first, unless the breach is flagrant.
We may also discontinue the service entirely, giving at least 30 days’ notice. A pilot is a pilot, and we do not promise that stamplik will exist forever.
6. What a Business must do
A Business:
- honours the Rewards it set in its own Program,
- is responsible for the content it enters, in particular its name, Reward descriptions and logo,
- ensures Staff only stamp for real transactions,
- is an independent controller of its Customers’ data to the extent it uses that data itself, for example recognising a regular or making them an offer. It is responsible for that on its own account. We are responsible for the data as far as running the service goes, which the Privacy policy describes.
A Business may not use Customer data obtained through stamplik for purposes unrelated to its own Program, nor pass it on to anyone else.
7. What a Customer must do
A Customer uses the service as intended and does not attempt to obtain Stamps other than through a real visit to a Venue.
Cards and Rewards belong to an Account. They cannot be transferred, sold or assigned to anyone else.
8. Unlawful content
Supplying unlawful content is prohibited, in particular content infringing third-party rights, offensive content, or content that misleads. This applies to every field that can be filled in, including a Business name, a Reward description and a logo.
We remove content breaching this clause and may block the Account that added it.
9. Liability
We work to keep the service running without interruption, but we do not guarantee uninterrupted availability. We may take it down temporarily for maintenance or repair.
We are not responsible if a Business fails to hand over a Reward, changes its Program or ceases trading. Claims of that kind go to the Business.
We are not responsible for the consequences of incorrect details being entered, or for access to an Account gained by someone you gave your device or Google account to.
For Customers who are consumers, our liability is limited only as far as the law allows. Nothing in these terms excludes rights a consumer has by statute.
10. Complaints
Send a complaint to hi@stamplik.app, describing what it concerns and what you expect. Include the email address on the Account.
We reply within 14 days, to the address the complaint came from.
A consumer may also use out-of-court complaint and redress procedures, including the assistance of a district or municipal consumer ombudsman (rzecznik konsumentów).
11. Personal data
The Privacy policy covers it. In short: we process only what the service needs, and we compute Businesses aggregate statistics about their program that are not attributed to any individual Customer. We do not profile you individually and we do not sell data.
12. Changes to these terms
We will give at least 14 days’ notice of a change, in the app. If you do not accept a change you may end the agreement within that time, at no cost.
A change does not affect Stamps and Rewards collected beforehand.
13. Governing law and disputes
Polish law applies. This does not reduce the protection a consumer has under the law of their country of residence, where that is more favourable to them.
Disputes with Businesses are heard by the court with jurisdiction over our registered address. Disputes with consumers are heard by the court determined under the general rules.
